These Terms of Service ("Terms") govern your use of the website Kelmexa and AI trading platform (together, the "Service") operated by Kelmexa Inc. ("Kelmexa", "we", "us", or "our"). By using the Service, you agree to these Terms. If you disagree, please do not use the Service.
1. Eligibility
Users must be 18 years or older to use our Service. By accessing it, you confirm you meet this age and have the legal capacity to agree to these Terms. The Service is unavailable where prohibited by law.
2. Account Creation
To fully use the Service, register with accurate and current information. You are responsible for securing your login credentials and all account activities. Notify us immediately at if you suspect unauthorized access.
We may suspend or terminate accounts violating these Terms, providing false information, or engaging in fraud.
3. Service Overview and Limitations
Kelmexa provides AI-based market insights, trade signals, and optional automated order execution via linked brokerage accounts. The Service is for informational purposes only.
- Kelmexa does not hold or control your funds; all capital remains in your brokerage or exchange accounts.
- We connect to your broker via API keys with read-only and trade execution permissions; these keys do not allow withdrawals.
- Past strategy or signal performance does not predict future outcomes.
- Trading involves risk, including loss of Kelmexa capital.
4. No Investment Advice
Nothing on the platform Kelmexa constitutes financial, investment, or trading advice. All AI signals and data are informational. Consult a licensed financial advisor before investing. Kelmexa is not a registered investment advisor, broker, or financial consultant.
5. Fees and Payments
Certain features require paid subscriptions. Fees are detailed on our pricing page and may change with 30 days’ prior notice. Taxes are your responsibility. Subscriptions are prepaid monthly or annually. Refunds are discretionary within 14 days of initial payment for new clients.
6. Acceptable Use
You agree not to:
- Use the Service illegally or violate laws.
- Attempt to reverse engineer or extract our platform's source code.
- Use bots or automated methods to scrape data from the Service.
- Resell or exploit the Service commercially without permission.
- Disrupt or harm the Service or its infrastructure.
- Engage in market manipulation, front-running, or illegal financial activities.
7. Intellectual Property Rights
All software, content, algorithms, trademarks, and trade secrets provided are the sole property of Kelmexa or its licensors. No rights or licenses to these assets are granted to you. Our trademarks and logos may not be used without prior approval.
8. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Kelmexa WE DO NOT GUARANTEE UNINTERRUPTED SERVICE OR THAT IT IS FREE FROM HARMFUL ELEMENTS.
9. Liability Limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kelmexa WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM USE OF THE SERVICE, EVEN IF ADVISED OF POSSIBILITIES. OUR LIABILITY IS LIMITED TO FEES PAID IN THE PAST 12 MONTHS. Kelmexa .
10. Indemnity
You agree to indemnify and hold harmless Kelmexa and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) resulting from your use of the Service, breach of these Terms, or violation of third-party rights.
11. Account Termination
You may close your account anytime via settings or by contacting We may suspend or end access immediately if these Terms are breached. Account data may be deleted in line with our Privacy Policy after closure.
12. Governing Law and Dispute Resolution
These Terms are governed by New York State laws, excluding conflict of law principles. Disputes will be settled by binding arbitration in Unit 101, Raheja Towers, M.G. Road, Bengaluru, Karnataka 560001, India under American Arbitration Association rules. EU and UK users may also pursue claims in local courts.
13. Changes to Terms
We may update these Terms anytime with at least 14 days’ notice via email or platform alerts. Continued use signifies acceptance.
